The ADA's Definition of Disability

The ADA defines disability as a physical or mental impairment that substantially limits one or more major life activities. A major life activity is any activity that is essential to everyday living, such as walking, talking, seeing, hearing, or working. The ADA also protects individuals who are regarded as having a disability, even if they do not have a disability.

The ADA's Prohibitions

The ADA prohibits discrimination against individuals with disabilities in employment, public accommodations, transportation, and telecommunications. Discrimination includes:

  • Denying an individual with a disability access to goods or services
  • Charging an individual with a disability a higher price for goods or services
  • Limiting the opportunities of an individual with a disability to participate in programs or activities
  • Harassing an individual with a disability
  • Retaliating against an individual with a disability for asserting his or her rights

The ADA's Amendments

The ADA has been amended several times since it was first signed into law. The most recent amendment, the ADA Amendments Act of 2008, was signed into law on September 25, 2008. The ADA Amendments Act of 2008 made several changes to the ADA, including:

  • Expanding the definition of disability
  • Clarifying the ADA's "undue burden" defense
  • Providing for the recovery of compensatory damages in ADA cases
  • Creating a new enforcement mechanism for the ADA

The ADA's Impact

The ADA has had a significant impact on the lives of individuals with disabilities. The ADA has helped to ensure that individuals with disabilities have equal access to employment, public accommodations, transportation, and telecommunications. The ADA has also helped to change attitudes about disability and to create a more inclusive society.
